Notice of Privacy Practices

This notice describes how AnchorPoint Recovery may use and disclose your Protected Health Information (PHI) to carry out treatment, payment, or health care operations. It also describes AnchorPoint Recovery’s legal obligations regarding your PHI and your rights to access and control it. This notice takes effect on April 14, 2003, in accordance with the privacy regulations issued under the federal Health Insurance Portability and Accountability Act of 1996 (“HIPAA Privacy Regulations”).

PHI refers to individually identifiable health information, including actual medical information as well as your name, address, phone number, identification number, or other identifiers, collected from you or created by or received by a health care provider, a health plan, or your employer, and that relates to:

  1. your past, present, or future physical or mental health condition;
  2. the provision of mental health care to you; or
  3. the past, present, or future payment for health care provided to you.

AnchorPoint Recovery is required by law to maintain the privacy of your PHI. AnchorPoint Recovery is obligated to provide you with a copy of this Notice, and AnchorPoint Recovery must abide by the terms of this Notice.

Uses and Disclosures of Protected Health Information (PHI)

Your PHI may be used and disclosed by your primary behavioral health provider (counselor and/or case manager), AnchorPoint Recovery office staff, and others outside of AnchorPoint Recovery offices who are involved in your care and treatment for purposes of providing health care services to you, to pay your health care bills, to support the operation of AnchorPoint Recovery practices, and any other use required by law.

Treatment: AnchorPoint Recovery may use and disclose your PHI to provide, coordinate, or manage your health care and other services related to your health care. This includes coordination or management of your health care with a third party, such as when AnchorPoint Recovery staff consult with the criminal justice agent(s) you report to, or another health care provider, such as your family physician or another behavioral health professional.

Payment: Your PHI may be used, as needed, to obtain payment for your health care services. Examples include disclosing PHI to the criminal justice agency that pays for your services or to a health insurer to obtain reimbursement for your health care, or to determine eligibility or coverage.

Health Care Operations: AnchorPoint Recovery may use and disclose your PHI for our health care operations. These activities include, but are not limited to, quality assessment and improvement activities, employee review activities, training of behavioral health students, licensing, and conducting or arranging business-related matters, such as audits, administrative services, and case management and care coordination.

Business Associates: AnchorPoint Recovery contracts with individuals and entities (business associates) to perform various functions on our behalf, which involve the use and/or disclosure of PHI. Business associates must agree in writing to safeguard your information appropriately. For example, AnchorPoint Recovery may disclose your PHI to a business associate to transport information between AnchorPoint Recovery locations or to store medical records.

Uses and Disclosures Requiring Authorization

AnchorPoint Recovery may use or disclose PHI for purposes outside of treatment, payment, or health care operations when your written authorization is obtained. You may revoke authorizations in writing at any time, with exceptions for actions already taken under the authorization or for court-ordered disclosures.

Uses and Disclosures with Neither Consent nor Authorization

AnchorPoint Recovery may use or disclose PHI without your consent in certain circumstances, including:

  • Required by law
  • Public health reporting
  • Child or adult abuse reporting
  • Health oversight activities
  • Legal proceedings
  • Serious threats to health or safety
  • Worker’s compensation
  • Appointment reminders
  • Situations where state or federal law imposes additional restrictions

Website and Data Privacy

AnchorPoint Recovery prioritizes your online privacy. Any data collected through our website, email, or phone communication is used solely to provide services, manage appointments, or share information about our programs. We do not sell or share your data for commercial purposes.

  • Email and Phone Communications: Emails or calls are used only for service-related communication or updates. You may opt out at any time by contacting us.
  • Cookies and Tracking: We do not use cookies to track personal activity. Third-party platforms may use cookies to collect anonymized usage data; you may opt out via their platforms.
  • Transparency: Policy updates will be posted on our website. You may contact us directly to request removal from any mailing or communication list.

HIPAA Notice of Privacy Practices: Clinical/PHI Privacy 

AnchorPoint Recovery safeguards your Protected Health Information (PHI) in accordance with HIPAA. This includes patient rights, disclosure practices, and complaint procedures.

Patient Rights:

  • Right to Access: You may inspect or obtain a copy of your PHI maintained by AnchorPoint Recovery, with certain legal exceptions. Fees may apply for copies or mailing.
  • Right to Request Restrictions: You may request restrictions on the use or disclosure of PHI for treatment, payment, or health care operations. AnchorPoint Recovery is not required to agree unless the payment is made out of pocket.
  • Right to Confidential Communications: You may request that PHI be communicated via alternative means or locations. Reasonable requests will be accommodated.
  • Right to Amend: You may request corrections to your PHI with a written explanation. Requests may be denied in specific circumstances.
  • Right to Accounting: You may request an accounting of certain PHI disclosures within the past six years, excluding treatment, payment, or operations disclosures.
  • Right to a Copy of this Notice: You may request a paper or electronic copy at any time.

Complaint Process 

If you are concerned that AnchorPoint Recovery has violated your privacy rights, or you disagree with a decision the staff made about access to your records, you may contact the AnchorPoint Recovery Privacy Officer.
