FMLA and rehab FAQ
- Often, yes, if you’re an eligible employee. Treatment for substance use by a health care provider, including residential treatment, can qualify for FMLA leave. The leave covers treatment, and using on the job falls under your employer’s policy. Check the three eligibility tests on this page, then talk to your HR department or an employment lawyer about your situation.
- FMLA leave is unpaid, and it is job-protected: eligible employees can take up to 12 weeks in a 12-month period for a serious health condition. Many states add their own leave laws, so ask your HR department what else applies where you work. Admissions can check your health plan benefits for the treatment itself, for free.
- Up to 12 weeks in a 12-month period, for eligible employees. Residential treatment at AnchorPoint is about 30 days, sometimes 45, which fits inside that limit. Your team decides the length with you as the work goes, and your return date can be shared with your employer if you give your written OK.
- Your employer receives the medical certification, and the details of your treatment stay private. Health information is kept confidential. AnchorPoint shares information about your care with your employer only with your written OK, so what you talk about in therapy stays between you and your team.
- If you’re eligible, FMLA gives you job protection during rehab while you take leave for treatment. That protection covers the treatment; discipline for using at work is handled under a company policy that applies to everyone. This page is general information, not legal advice: talk to your HR department or an employment lawyer about your situation.
- Yes. AnchorPoint’s admissions team helps you fill out the medical certification with your provider. Your employer gives you the form, your provider signs it, and admissions walks you through it so the leave can be in place when you start treatment. Call admissions as soon as you’ve told HR you need medical leave.
- Three tests apply. Your employer has 50 or more employees within 75 miles of where you work, you have worked there for at least 12 months, and you have worked at least 1,250 hours in the last 12 months. If you meet all three, residential treatment for substance use can qualify. Ask HR to confirm your eligibility.
- Tell your HR department you need medical leave. They give you the medical certification form, your health care provider fills it out and signs it, and AnchorPoint’s admissions team helps with that step. Then you start treatment.
- FMLA covers treatment for substance use by a health care provider, including residential treatment, with up to 12 weeks of unpaid, job-protected leave for eligible employees. Pay during leave and discipline for using at work sit outside FMLA, under your pay arrangements and company policy. Talk to your HR department about how this works where you work.
- You may still have options. Many states add their own leave laws, and the Americans with Disabilities Act (ADA) can also protect people in recovery. Talk to your HR department or an employment lawyer about your situation before you decide. Admissions can still check your benefits for treatment, for free.
